These Terms explain how shopping at the Lady Truck View store works: how to place an order, how you will receive your e-book or parcel, what rights you have when withdrawing from a contract or making a complaint, and how you may use the e-books you buy. § 2. Definitions
The terms used in these Terms have the following meanings:
- Store – the Lady Truck View online store run by the Seller at https://ladytruckview.com.
- Seller – Dorota Tobór, whose details are given in § 1.
- Customer – a Consumer who uses the Store or concludes a contract with the Seller and, in the exceptional cases described in § 4 (Scope of sales), also another person who has concluded a contract with the Seller. A minor may place orders only to the extent permitted by law, in particular in minor everyday matters or with the consent of a legal representative.
- Consumer – a natural person who performs a legal transaction with the Seller that is not directly related to their business or professional activity.
- Sole Trader with Consumer Rights – a natural person who concludes a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for that person, as determined in particular by the subject of their business activity disclosed in the CEIDG register.
- Product – a Physical Product or a Digital Product available in the Store.
- Physical Product – a movable item (goods) sold and delivered to the Customer as a parcel.
- Digital Product – digital content supplied as a file, without a tangible medium, in particular an e-book.
- E-book – an electronic publication made available in the format stated in the Product description, e.g. PDF.
- Order – the Customer's declaration of intent made using the order form and aimed directly at concluding a contract.
- Contract – a contract for the sale of a Physical Product or a contract for the supply of a Digital Product concluded between the Seller and the Customer through the Store.
- Durable Medium – a material or tool that makes it possible to store information and reproduce it in unchanged form, e.g. an email or a PDF file.
- Terms – these Terms of Sale.
§ 3. Rules for using the Store
- Browsing the Store is free of charge. Placing an Order does not require creating an account.
- To use the Store you need a device with internet access, an up-to-date web browser with JavaScript and the cookies necessary for the Store to work enabled, and an active email address. To use E-books you need a program or app that can open files in the format stated in the Product description, e.g. PDF.
- The Seller provides, by electronic means, a free service of making the order form available. The contract for this service is concluded when the Customer starts filling in the form and terminates when the Order is placed or when the Customer stops filling in the form earlier. The rules for subscribing to and running the newsletter are described in the Privacy Policy.
- The Customer undertakes to use the Store in accordance with the law and good practice, to provide true information and not to supply any unlawful content.
- Using services provided by electronic means involves typical internet risks, such as malware, attempts to obtain data fraudulently (phishing) or interception of email. I recommend using up-to-date software and being cautious about messages impersonating the Store.
- Comments and complaints about how the Store works can be sent to hello@ladytruckview.com. A reply will be given within 14 days of receipt.
§ 4. Placing orders and concluding contracts
Scope of sales
The Lady Truck View Store sells exclusively to consumers, i.e. natural persons making a purchase for purposes not directly related to their business or professional activity.
The Store does not sell to traders making purchases in the course of their business or professional activity.
Orders can only be placed by customers with a billing address in a Member State of the European Union.
If, despite the above rules, a contract with the Seller is exceptionally concluded by a person who is not a Consumer, the provisions of these Terms concerning Sole Traders with Consumer Rights or Customers who are not consumers – as appropriate to that person's status – and the mandatory provisions of law shall apply to that person. This reservation is purely protective and does not mean that the Store sells to traders.
- Product information presented in the Store is an invitation to conclude a contract.
- To place an Order, add a Product to the cart, go to the order form, provide the details needed to fulfil the Order, choose one of the available payment methods and, for Physical Products, also a delivery method, read the Terms and confirm the Order using a button that clearly indicates that placing the Order involves an obligation to pay, e.g. “Order & Pay” (in the Polish version of the Store: “Kupuję i płacę”).
- Before placing an Order, the Customer can see the total price of the Products, any delivery costs and the total amount to be paid.
- The Contract is concluded when the Order is placed.
- After the Order is placed, the Seller sends the Customer a confirmation of the conclusion of the Contract to the email address provided. The confirmation is provided in the body of an email, which is a Durable Medium, without undue delay after the Contract is concluded and at the latest when the download link for the E-book is made available or when the Physical Product is delivered. The email contains the information required by law, in particular the Seller's details, a description of the Products ordered, the total price, information about the right to withdraw from the Contract together with the model withdrawal form, and information about complaints, and in the case of an E-book also confirmation of the consent referred to in § 8(13), if the Customer has given it. The email may also include a link to the Terms.
- Contracts are concluded in Polish. A Customer who uses the English version of the Store and is not a Consumer resident in Poland may conclude the Contract in English on the basis of the English version of the Terms. For Consumers resident in Poland, the Polish version of the Terms is binding.
- If the chosen payment method requires a separate payment and payment is not made within the time stated in the Order information, the Seller may set the Customer an additional deadline and, if it expires without payment, withdraw from the Contract, informing the Customer by email.
§ 5. Prices, payments and payment methods
- Product prices are given in Polish zloty (PLN) and are the final prices payable for the Product. Any delivery costs for Physical Products are shown separately before the Order is placed. No delivery costs are added to E-books.
- At the Customer's request, the Seller issues an invoice documenting the sale in accordance with applicable tax law. The request can be sent to the Seller's email address together with the details needed to issue the invoice.
- The available payment methods are shown in the order form before the Order is placed. The Seller does not charge any additional fees for using a particular payment method. If a payment is handled by an external operator, the operator's name is shown next to the payment method.
- The price that applies is the price valid at the time the Order is placed. Any later change in price does not affect Orders already placed.
- When a Product's price is reduced, the Seller shows, next to the reduced price, the lowest price of that Product in the 30 days before the reduction.
- If discount codes or promotions are available in the Store, their terms are set out each time in the description of the promotion.
§ 6. Delivery of digital products
- E-books and other Digital Products are supplied exclusively by electronic means, without a tangible medium, in the format stated in the Product description.
- Once payment has been received, the E-book is automatically made available for download via a link shown on the Order confirmation page and sent to the email address given in the Order. The E-book is supplied when the download link is made available to the Customer. The E-book is made available in the same way regardless of whether the Customer has given the consent referred to in § 8(13) – that consent determines only whether the right to withdraw from the Contract is kept or lost.
- The Seller supplies the E-book without undue delay once payment has been received. If the download link has not arrived within 24 hours, please check your spam folder and then contact the Seller at hello@ladytruckview.com.
- Unless the Product description states otherwise, the download link has no limit on the number of downloads and no expiry date. I recommend saving the downloaded file on your own device.
- The Customer is responsible for providing a correct email address. If the address contains an error, please contact the Seller without delay.
§ 7. Delivery of physical products
- This section applies to Orders that include Physical Products, if such Products are offered in the Store.
- Physical Products are delivered only within Poland.
- The available delivery methods and their costs are shown in the Product description or in the order form before the Order is placed.
- The Order processing time is stated in the Product description. If it is not stated, the Seller delivers the Physical Product without undue delay and no later than 30 days after the Contract is concluded.
- For a Consumer and a Sole Trader with Consumer Rights, the risk of accidental loss of or damage to the Product passes to the Customer when the Product is handed over to them.
- If a parcel arrives damaged, I recommend taking photos of the packaging and the Product and contacting the Seller as soon as possible. The lack of photos or a damage report does not deprive a Consumer of the right to make a complaint.
- Handmade Products may differ slightly in colour, texture, shape or finish. If these features are consistent with the description and photos of the Product, they do not in themselves mean that the Product does not conform to the Contract.
§ 8. Right of withdrawal
General rules
- A Consumer and a Sole Trader with Consumer Rights may withdraw from a Contract concluded at a distance within 14 days, without giving any reason and without incurring any costs other than those set out in these Terms.
- The withdrawal period runs: for Physical Products – from the day on which the Customer, or a third party other than the carrier indicated by the Customer, takes possession of the Product, and if the Order covers several Products delivered separately – from taking possession of the last of them; for Digital Products – from the day the Contract is concluded.
- To withdraw from the Contract, send a statement to hello@ladytruckview.com or by post to: ul. Armii Krajowej 16/2/6, 41-943 Piekary Śląskie, Poland. You may use the withdrawal form (in Polish, available to download as a PDF file or Word file), but you are not required to do so.
- To meet the deadline, it is enough to send the statement before the withdrawal period expires. The Seller will confirm receipt of the statement by email without undue delay.
- If the Customer withdraws from the Contract, the Contract is deemed not to have been concluded.
Physical products
- The Customer returns the Physical Product without undue delay and no later than 14 days after withdrawing from the Contract, to: ul. Armii Krajowej 16/2/6, 41-943 Piekary Śląskie, Poland. The deadline is met if the Product is sent back before it expires.
- The Customer bears the direct cost of returning the Product. The Product should be properly protected for transport. The original packaging is not a condition of the return.
- The Customer is liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics and functioning.
- The Seller refunds all payments received, including the cost of delivery corresponding to the cheapest standard delivery method offered in the Store, without undue delay and no later than 14 days after receiving the statement of withdrawal. The Seller may withhold the refund until the Product has been received back or the Customer has supplied evidence of having sent it back, whichever is earlier.
- The refund is made using the same means of payment that the Customer used, unless the Customer has agreed to another method of refund that involves no costs for them.
- The right of withdrawal does not apply in the cases set out in Article 38 of the Polish Act of 30 May 2014 on Consumer Rights, in particular to Products made to the Customer's specifications or clearly personalised to meet their individual needs, Products that are liable to deteriorate or expire rapidly, and Products supplied in sealed packaging that cannot be returned for health protection or hygiene reasons once the packaging has been opened after delivery.
E-books and other digital products
- A Consumer and a Sole Trader with Consumer Rights may withdraw from a Contract for the supply of a Digital Product within 14 days of its conclusion, subject to point 15.
- Before placing an Order, the Customer may agree to receive the E-book immediately after paying for the Order, before the withdrawal period ends, and confirm that they understand and acknowledge that they will lose the right to withdraw from the Contract once the E-book has been made available to them. A separate field in the order form is used for this purpose; it is not ticked by default and is separate from accepting the Terms. Giving this consent is voluntary and is not a condition of placing an Order.
- Merely accepting the Terms, making payment or receiving the download link does not cause the loss of the right to withdraw from the Contract. If the Customer does not give the consent referred to in point 13, they keep the right to withdraw from the Contract within 14 days of its conclusion, even after downloading the E-book, and if they withdraw, the Seller refunds the full price paid.
- The right to withdraw from a Contract for the supply of a Digital Product does not apply if all of the following conditions are met: (a) the Seller began supply with the Customer's express prior consent, (b) before supply began, the Customer was informed that they would lose the right of withdrawal once the Seller had performed the Contract, and acknowledged this, and (c) the Seller provided the Customer with confirmation of the conclusion of the Contract on a Durable Medium, including confirmation of the consent given (the email referred to in § 4(5)). If any of these conditions is not met, the Customer keeps the right to withdraw from the Contract within the period set out in point 12.
- After withdrawing from a Contract for the supply of a Digital Product, the Customer should refrain from using the E-book and from making it available to third parties. The Seller may prevent further downloading of the file. The E-book does not need to be physically returned. The Seller refunds the payment without undue delay and no later than 14 days after receiving the statement of withdrawal, using the same means of payment that the Customer used, unless the Customer has agreed to another method that involves no costs for them.
- Losing the right of withdrawal does not affect the right to make a complaint about an E-book that does not conform to the Contract.
§ 9. Complaints about physical and digital products
General rules
- The Seller is liable to a Consumer and a Sole Trader with Consumer Rights for the conformity of the Product with the Contract under the Polish Act of 30 May 2014 on Consumer Rights.
- A complaint can be made by email to hello@ladytruckview.com or by post to: ul. Armii Krajowej 16/2/6, 41-943 Piekary Śląskie, Poland.
- To help process the complaint, it is useful to give the Order number, the Product name, a description of the problem and what you are requesting, and, where possible, to attach photos or a screenshot of the error message. These are not conditions for making a complaint. A receipt is not required – the purchase can be proven in another way, e.g. with the Order or payment confirmation.
- The Seller replies to a complaint within 14 days of receiving it, on paper or another Durable Medium, e.g. by email.
Physical products
- The Seller is liable for any lack of conformity of a Physical Product with the Contract that exists when it is delivered and becomes apparent within 2 years of that time.
- If a Physical Product does not conform to the Contract, the Customer may request that it be repaired or replaced. If repair or replacement is impossible, the Seller has not brought the Product into conformity with the Contract within a reasonable time, the lack of conformity persists despite an attempt to remedy it, or the lack of conformity is so serious that it justifies this immediately, the Customer may declare a price reduction or withdrawal from the Contract. Withdrawal from the Contract is not possible if the lack of conformity is minor.
- The costs of repair, replacement, collection and return of a Product that does not conform to the Contract are borne by the Seller. The Seller refunds the amount due as a result of a price reduction or withdrawal from the Contract without undue delay and no later than 14 days after receiving the Customer's declaration.
E-books and other digital products
- The Seller is liable for any lack of conformity of a Digital Product with the Contract that exists when it is supplied and becomes apparent within 2 years of that time.
- If the E-book does not conform to the Contract, e.g. it cannot be downloaded or opened, or the file is damaged or incomplete, the Customer may request that it be brought into conformity with the Contract. The Seller will do so at its own expense, within a reasonable time and without significant inconvenience to the Customer, unless this would be impossible or would involve disproportionate costs.
- In the cases provided for by law, in particular where bringing the E-book into conformity with the Contract is impossible, has not been done within a reasonable time, the lack of conformity persists or is so serious that it justifies this immediately, the Customer may declare a price reduction or withdrawal from the Contract. Withdrawal from the Contract is not possible if the lack of conformity is minor.
- The Seller refunds the amount due as a result of a price reduction or withdrawal from the Contract without undue delay and no later than 14 days after receiving the Customer's declaration, using the same means of payment, unless the Customer agrees to another method that involves no costs for them. A complaint about an E-book does not require the file to be sent back.
Customers who are not consumers
- For Customers who are neither Consumers nor Sole Traders with Consumer Rights, the Seller's liability under the statutory warranty for defects (rękojmia) is excluded to the extent permitted by law.
§ 10. Copyright and rules for using e-books
- E-books, texts, photos, graphics and other materials available in the Store are works protected by copyright. The rights to them belong to the Seller or other rights holders.
- When the E-book is supplied, the Customer receives a non-exclusive, non-transferable licence to use it for their own personal use, without territorial or time limits.
- Under the licence, the Customer may in particular: read the E-book on their own devices, make a backup copy, print it in whole or in part for their own use, and use the checklists it contains for their own purposes.
- Without the Seller's consent, it is in particular not permitted to: share, distribute or resell the E-book or parts of it, publish it online, including in publicly accessible folders, cloud storage or file-sharing services, alter its content or present it as one's own, or use it for commercial purposes, e.g. in paid training sessions or courses.
- The provisions of this section do not limit permitted use or the right to quote provided for in the Polish Act of 4 February 1994 on Copyright and Related Rights.
- The content of the E-books is informational and advisory in nature. It does not constitute legal advice and does not replace applicable regulations, training, employer instructions or vehicle documentation.
§ 11. Personal data protection
- The controller of Customers' personal data is the Seller – Dorota Tobór. For matters relating to personal data, please contact hello@ladytruckview.com.
- Personal data provided in the Order are processed in order to conclude and perform the Contract (Article 6(1)(b) GDPR), to comply with legal obligations, including tax obligations and obligations relating to handling complaints (Article 6(1)(c) GDPR), and to establish, pursue or defend claims (Article 6(1)(f) GDPR).
- Providing data is voluntary but necessary to place an Order and perform the Contract. For E-books, the email address is also used to send the download link.
- Data may be shared with entities that help fulfil the Order, in particular hosting and email providers, payment operators and – for Physical Products – carriers, only to the extent necessary for them to perform their tasks.
- Subscribing to the newsletter is voluntary and is not a condition of placing an Order.
- Detailed information about the processing of personal data, retention periods and your rights is provided in the Privacy Policy, and information about cookies in the Cookie Policy.
§ 12. Out-of-court dispute resolution
- A Consumer may use out-of-court methods of handling complaints and pursuing claims. In particular, they may apply to the Voivodeship Inspector of the Trade Inspection (Inspekcja Handlowa) to initiate out-of-court dispute resolution proceedings or to have the case heard by a permanent consumer arbitration court, and may obtain free assistance from a district (municipal) consumer ombudsman or a consumer organisation.
- The list of entities authorised to conduct out-of-court consumer dispute resolution proceedings is kept by the President of the Office of Competition and Consumer Protection (UOKiK). Information is available at uokik.gov.pl.
- In cross-border disputes, a Consumer may seek help from the European Consumer Centre Poland.
- Participation in out-of-court proceedings is voluntary for both parties. If the Seller does not accept a Consumer's complaint, the Seller will state in its reply whether it agrees to out-of-court dispute resolution.
- This section does not apply to Sole Traders with Consumer Rights.
§ 13. Final provisions
- Contracts concluded through the Store are governed by Polish law. This choice of Polish law does not deprive a Consumer of the protection afforded by provisions that cannot be derogated from by agreement under the law of the country of their habitual residence.
- Disputes with Consumers are resolved by the courts having jurisdiction under general rules. Disputes with Customers who are neither Consumers nor Sole Traders with Consumer Rights are resolved by the court having jurisdiction for the Seller's place of residence.
- The Seller may amend the Terms for important reasons, in particular changes in the law, changes to payment or delivery methods, or the introduction of new Store features. Orders placed before an amendment are fulfilled under the version of the Terms in force when they were placed.
- Matters not covered by the Terms are governed by Polish law, in particular the Civil Code, the Act on Consumer Rights, the Act on the Provision of Electronic Services, the Act on Copyright and Related Rights, and the GDPR.
- These Terms apply from [publication date – to be completed].
